These Terms of Service govern your access to and use of the ScrubLayer website, platform, APIs, and related services operated by ScrubLayer, Lansdale, Pennsylvania 19446, USA.

1. Acceptance of Terms

By accessing or using ScrubLayer you agree to be bound by these Terms. If you do not agree, do not use the service. If you are using ScrubLayer on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

SCRUBLAYER PROVIDES AI-ASSISTED CONTENT ANALYSIS TOOLS ONLY. ALL RESULTS ARE ALGORITHMIC ESTIMATES GENERATED BY ARTIFICIAL INTELLIGENCE AND ARE NOT PROFESSIONAL OPINIONS, CERTIFICATIONS, OR GUARANTEES OF ANY KIND.

The Service includes AI detection, hallucination checking, brand voice analysis, legal risk flagging, SEO quality scoring, readability analysis, and related content audit features. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Prohibited Uses

Users may NOT:

  • Use results to make decisions with legal or material impact on any person including credit, educational, employment, housing, insurance, legal, or medical decisions.
  • Use results as the sole basis for academic integrity decisions, disciplinary actions, or grade determinations.
  • Submit content they do not own or have rights to analyze.
  • Attempt to reverse engineer, copy, or replicate the service.
  • Use automated scripts or bots to access the service without written permission.
  • Resell or redistribute results without written permission from ScrubLayer.
  • Use the service if under 13 years of age.

Violation of any prohibited use may result in immediate account suspension or termination without notice or refund.

4. Disclaimer of Warranties

SCRUBLAYER SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, SCRUBLAYER EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SCRUBLAYER MAKES NO WARRANTY THAT: (A) RESULTS ARE ACCURATE, COMPLETE, OR RELIABLE; (B) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (C) ANY CONTENT WILL BE CORRECTLY CLASSIFIED AS AI-GENERATED OR HUMAN-WRITTEN; (D) RESULTS ARE SUITABLE FOR ANY PARTICULAR PURPOSE INCLUDING ACADEMIC, LEGAL, MEDICAL, OR BUSINESS USE.

5. Limitation of Liability

IN NO EVENT SHALL SCRUBLAYER, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES INCLUDING BUT NOT LIMITED TO: LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY RESULTS OR ANALYSIS PROVIDED BY THE SERVICE; (C) ANY DECISIONS MADE BASED ON SERVICE RESULTS; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA. SCRUBLAYER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (I) THE AMOUNT YOU PAID TO SCRUBLAYER IN THE THREE MONTHS PRECEDING THE CLAIM, OR (II) FIFTY DOLLARS ($50).

6. No Professional Advice

ScrubLayer analysis does not constitute legal, medical, financial, academic, journalistic, or professional advice of any kind. Results should never be relied upon as the sole basis for any professional, academic, business, or personal decision. Always consult qualified professionals.

7. Academic Integrity Disclaimer

ScrubLayer reports are analytical tools only. They should NOT be the sole basis for academic integrity decisions, disciplinary actions, grade changes, or accusations of misconduct. AI detection technology is imperfect and produces false positives. Educators and institutions assume full and sole responsibility for how they use ScrubLayer results. ScrubLayer is not liable for any academic, professional, or personal consequences arising from decisions based on its analysis.

Before taking any action against a student based on AI detection results, institutions must conduct an independent investigation, give the student an opportunity to respond, and follow all applicable institutional policies and applicable law including FERPA.

8. AI Detection Limitations

AI content detection is an evolving technology with known limitations. ScrubLayer detection algorithms may:

  • Produce false positives — flagging human-written content as AI-generated.
  • Produce false negatives — failing to detect AI-generated content.
  • Vary in accuracy based on content type, length, and writing style.

No AI detector is 100% accurate. Results should be treated as one data point among many, not as definitive proof of AI authorship or human authorship. You expressly agree not to use ScrubLayer AI detection results as standalone evidence in any legal, academic, or employment proceeding.

9. Content You Submit

You retain full ownership of content you submit. By submitting content you grant ScrubLayer a limited, non-exclusive, royalty-free license to process it solely to provide the service. ScrubLayer will not sell, share, or publish your submitted content. ScrubLayer may use anonymized aggregated statistical data to improve the service.

You represent and warrant that you have all rights necessary to submit the content and that doing so does not violate any applicable law or third-party rights.

10. Payment Terms

  • Single reports ($9) are non-refundable once the audit has been generated.
  • Subscriptions may be cancelled at any time with no refund for the current billing period.
  • Chargebacks or payment disputes may result in immediate account termination.
  • Prices may change with 30 days notice to active subscribers via email.

All payments are processed by Stripe, Inc. We do not store full payment card numbers, CVV codes, or bank account details on our servers.

11. Indemnification

You agree to defend, indemnify, and hold harmless ScrubLayer and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses including attorney fees arising from: your use of the service; your violation of these Terms; your violation of any third party rights; or any decisions you make based on ScrubLayer results.

12. Dispute Resolution

  • Governing law: Commonwealth of Pennsylvania, United States.
  • Mandatory binding arbitration administered by the American Arbitration Association (AAA) is required before litigation. Contact support@scrublayer.com first to attempt informal resolution within 30 days.
  • Class action waiver: You waive the right to participate in class action lawsuits or class-wide arbitration against ScrubLayer.
  • Small claims court exception: Either party may bring an eligible dispute in small claims court in lieu of arbitration.

13. Termination

ScrubLayer may suspend or terminate your account at any time at its sole discretion without notice or liability. You may terminate your account at any time from your account dashboard. Sections 4, 5, 6, 7, 8, 11, and 12 survive termination.

14. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. We will post updated Terms on this page with a revised date and, for material changes, notify active subscribers by email.
